TERMS OF SERVICE
Introduction
Apex Ability ("we" or "us") provides community participation support services to individuals with disabilities ("clients") using National Disability Insurance Scheme (NDIS) funding. These terms and conditions ("Terms") govern the use of our services by clients and their NDIS support coordinators and plan/fund managers ("you").
Service provision
We will provide community participation support services to clients in accordance with the support plan approved by the NDIS. The services will be provided in a safe and professional manner by our trained and experienced support workers.
NDIS funding
We will invoice the NDIS for the approved services on a regular basis, typically monthly. Our invoices will be detailed and itemized, and will clearly show the services provided, the date and time of the services, and the cost of the services.Client responsibility
You are responsible for ensuring that you have the necessary NDIS funding to access our services. We will provide you with an estimate of the cost of the services before we commence delivery of the services.
Cancellation and rescheduling
We require at least 24 hours notice for any cancellation or rescheduling of a service. If notice is not given, or if you fail to attend a scheduled service, you may be charged for the full cost of the service.
Confidentiality
We will keep all client information confidential in accordance with our privacy policy.
Limitation of Liability
We will not be liable for any loss or damage suffered by you as a result of the services provided by us, except to the extent that such loss or damage is caused by our negligence or wilful misconduct.
Governing Law
These terms and conditions are governed by the laws of the jurisdiction in which we operate.
Changes
We reserve the right to make changes to these terms and conditions at any time. Any changes will be posted on our website.
Indemnification
You agree to indemnify us against any claims, losses, liabilities, damages, costs, and expenses (including legal fees) that we may incur as a result of your use of our services.
Dispute Resolution
In the event of a dispute arising out of or in connection with these terms and conditions, the parties will attempt to resolve the dispute through good faith negotiations.

Service quality and feedback
We are committed to providing high-quality services to our clients. We welcome feedback and complaints as they provide us with an opportunity to improve our services. We will respond to feedback and complaints in a timely and appropriate manner.
Termination
We reserve the right to terminate the provision of our services to you at any time if you breach these terms and conditions or if we are unable to provide the services to you due to a change in your NDIS funding or support plan.
Severability
If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Entire Agreement
These terms and conditions constitute the entire agreement between you and us regarding the use of our services and supersede any prior agreements or understandings, whether written or oral.
